The granting of the Belgian nationality to a child is not always automatic and sometimes requires a declaration from the parents :

  • before his 5th birthday, if he was born abroad

  • before his 12th birthday, if he was born in Belgium to long-established foreign parents.

Stateless persons

The law also provides facilities for 

the acquisition of Belgian nationality

by stateless persons recognized in Belgium,

via the exceptional procedure

of naturalization.

In practice, problems are frequent because many municipal administrations do not really respect the procedure and deadlines imposed by the law and have an unwelcoming behavior - even definitely racist - with regard to most foreigners, especially if they do not have a residence permit.
